These terms govern your use of the Quantum Ghost app ("the App"), published by Embay, LLC ("we", "us"). By downloading or using the App, you agree to them. If you do not agree, do not use the App.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, in accordance with the Apple Media Services Terms and Conditions and the Usage Rules in Apple's App Store Terms of Service. You may not copy, modify, reverse-engineer, redistribute, or resell the App except as permitted by law.

2. Entertainment only

Quantum Ghost is a work of interactive fiction and entertainment. The "entities", "ghosts", "signals", and "readings" it presents are generated for gameplay and do not represent, detect, or measure any real paranormal, supernatural, medical, environmental, or safety-related phenomenon. Do not rely on the App for any factual, diagnostic, navigational, or safety purpose. Always be aware of your real-world surroundings while playing an augmented-reality game — watch for traffic, obstacles, other people, and private property, and do not use the App while driving or in any hazardous situation.

3. Purchases

The App is free to download and offers an optional one-time in-app purchase, "Quantum Ghost Pro", which unlocks additional features. All purchases are processed by Apple and are subject to Apple's terms. Prices are shown in the App before purchase. Because the purchase is a non-consumable one-time unlock, it is tied to your Apple Account and can be restored on your devices. Refunds are handled solely by Apple according to its policies; we cannot issue refunds directly.

4. Your device and environment

The App requires an iPhone running a supported iOS version, with access to Bluetooth and the camera to function; LiDAR-equipped iPhones additionally render entities hiding behind real objects. Gameplay is generated from the Bluetooth signal environment around you and will differ from place to place; the absence of nearby signals is a normal, intended condition, not a defect. You are responsible for the device you use and for any mobile-data or battery use.

5. Privacy

Our handling of data is described in our Privacy Policy, which forms part of these terms. In short: the App has no server and no accounts, transmits nothing you scan off your device, and collects only anonymous, consent-gated usage and crash diagnostics that you can turn off in the App.

6. Intellectual property

The App, including its code, artwork, procedural generation, audio, text, and the "Quantum Ghost" name and marks, is owned by Embay, LLC and protected by intellectual-property laws. Content you generate in the App (captures, collections) is yours; the software that produces it remains ours.

7. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or available at all times.

8. Limitation of liability

To the maximum extent permitted by law, Embay, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us for it, if any. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Changes

We may update the App and these terms from time to time. Material changes to these terms will be posted here with an updated date. Continued use of the App after a change constitutes acceptance of the revised terms.

10. Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules, except where your local consumer-protection law provides otherwise.
